20110148 - PHILOSOPHY OF THE LAW

The course aims at the following learning objectives:
a) being familiar with the main authors and theories which have influenced contemporary legal culture; b) to acquire competences in relation to the main concepts of legal theory; c) to develop a critical approach to legal knowledge and culture.

Programma

The course consists of two parts.
The first part will be devoted to the problem of defining the concept of law and to the main strategies for responding to this problem, with particular reference to the classic theme of the relationship between law and morality and the philosophical-legal conceptions that offer a different reconstruction of it (natural law, legal positivism).
The second part will be devoted to illustrating the evolutionary path that has led to the current constitutional state of law, analysing its foundations and most recent transformations, with particular attention to the theme of the so-called administration of rights (structure, logic, function and interpretation of rights; conflicts between rights and their solutions).

Modalità Valutazione

The test consists of a multiple-choice quiz (6 questions) and two open-ended questions. The exam lasts 60 minutes. Multiple-choice questions: answer in 10 minutes maximum. If more than four incorrect answers are given, the assessment will be “unsatisfactory”. At the end of the ten minutes allocated, the test must be handed in to the members of the examination board. Open-ended questions: answer without exceeding the maximum space allocated. To pass the exam, you must obtain at least a satisfactory assessment in each of the above tests. In the event of a positive assessment, a mark out of thirty will be awarded, corresponding to the average of the marks obtained in each of the tests. The mark may be accepted or rejected, by tacit consent, within seven days of the publication of the results. The papers will be kept exclusively until the final recording of the examination mark. After this period, it will no longer be possible to access them.

3) The third module provides and introduction to the problem of war in critical legal studies and a focus on postcolonial and gender perspective.

The course will introduce the students to the central topics in the philosophy of law (such as the concept of norm, of legal system, of legal interpretation, of legal rights), from the perspective of the evolution of 'constitutionalism', or 'rule of law', from the XVIII century onwards.
