The course is aimed to provide, through the study and the deepening of the relevant legislation and case - law, the fundamental notions of employment law with regard to both trade union law and industrial relations, contract and employment relationship, also in public administrations, and, finally, social security law, public and private.

Programma

The course is aimed to analyze and deepen the trade union law, the discipline of the individual employment relationship, employment in public administrations and public and private social security. Particular attention will be paid to the most recent regulatory reforms and their application by case-law.
First of all, general notions and sources (domestic and international) of employment law will be examined in the context of economic globalization and the crisis of the welfare state (1st teaching unit).
Then the study of trade union law will be addressed, including the following topics: historical evolution and sources; trade union organisation; collective bargaining; problems of trade union representation; strike, including in essential public services (2nd unit).
Subsequently, the discipline of the contract and the employment relationship will be examined in greater depth, and in particular the following topics: the labour market; the subordinate employment relationship, its nature and connotations, differences with respect to the self-employment relationship; the types of employment relationships and contractual models; the matching of labour supply and demand; the employment contract, subjective and objective requirements; the obligations of the employer; the powers of the employer; the protection of the freedom and dignity of the employee; the rights of the worker and in particular the rights of the person and remuneration; the content of the employment performance; the termination of the employment relationship and in particular individual and collective dismissals; the protection of the rights of the employee; changes in the employment relationship, with particular reference to the transfer of the company; employment in public administrations (3rd unit).
Finally, there will be an in-depth study of public and private social security, and in particular: constitutional principles; pension protection; supplementary social security; protection against accidents at work and occupational diseases; protection against involuntary unemployment (4th unit).

Modalità Erogazione

The course will consist of classroom lectures on the themes of the exam programme, which will also include exercises, in-depth seminars, analysis of practical cases and judgements. The attendance of the course is not compulsory.

Modalità Valutazione

The verification of the acquired learning will be executed by means of an oral test. There will be at least three questions and they will cover the entire content of the examination programme. The purpose of the questions is to verify the level of learning and understanding of the topics and concepts covered by the course. The following in particular will be assessed: argumentative logic, ownership of legal language and ability to apply the concepts studied in practice. ERASMUS students will be asked to write a comparative thesis on a single institution, chosen by the student, between the law of the country of origin and the Italian law. The thesis (at least 20/30 pages long) must be delivered on the day of the test, during which the student will illustrate the contents and results of the work carried out. For those who fail the exam or refuse the grade, it is possible to take the exam in the next appeal. It is not possible to take the Employment Law exam and the Employment Law II exam in the same appeal.

Programma

The classes aim to give the fundamental elements of the employment law, focusing in particular on industrial relations, employment contract and relationship, social security, even taking in account the most recent changes happened in the field
Il programma del corso comprende il diritto sindacale, la disciplina del rapporto individuale di lavoro, il lavoro nelle pubbliche amministrazioni e la previdenza sociale. La trattazione del diritto sindacale comprende i seguenti argomenti:
1) l’organizzazione sindacale;
2) la contrattazione collettiva;
3) lo sciopero.
La disciplina del rapporto individuale dì lavoro sarà introdotta da un’analisi delle fonti interne ed internazionali del diritto del lavoro. Verranno, poi, affrontati i seguenti argomenti:
1) il rapporto di lavoro subordinato: natura e connotati. Differenze rispetto al rapporto di lavoro autonomo;
2) la tipologia dei rapporti di lavoro;
3) il divieto di interposizione e d’intermediazione nelle prestazioni di lavoro;
4) l’incontro tra domanda e offerta di lavoro;
5) il contratto di lavoro: requisiti soggettivi ed oggettivi;
6) gli obblighi del prestatore di lavoro;
7) i poteri del datore di lavoro;
8) la tutela della libertà e dignità del lavoratore;
9) i diritti del lavoratore;
10) il contenuto della prestazione lavorativa;
11) l’estinzione del rapporto di lavoro;
12) la tutela dei diritti del prestatore di lavoro;
13) le vicende modificative del rapporto di lavoro con particolare riferimento al trasferimento d’azienda;
14) il lavoro nelle pubbliche amministrazioni.
Per quanto attiene alla parte relativa al diritto della previdenza sociale, gli argomenti trattati riguarderanno:
1) l’evoluzione storico-giuridica della previdenza sociale nell’ordinamento italiano;
2) l’attuale sistema giuridico della previdenza sociale.
Infine, il corso affronta, in una prospettiva sistematica, le innovazioni più recenti del diritto del lavoro, con particolare riguardo alle seguenti tematiche: il diritto internazionale e dell’unione europea; la riforma del mercato del lavoro; la revisione delle tutele.
