The aim of this module is to stimulate students' interest in the subject studied in Administrative Law also through the analysis of case law. The course will focus, in the first half, on some issues of substantive Administrative law (with specific reference to the rules of administrative action) and the second part in a survey of the " features" of the system of Administrative justice.

The course for non-attending students includes the study of the text: S. Cassese (ed.), The new economic constitution, Laterza, 2021 (all chapters) and the exam consists of an oral test. The text illustrates how the States have been replaced, in the regulation of the economy, by supranational institutions, whereas the national system, which is part of the European one, is required to constantly adapt to these new developments while it is European law that is responsible now, to establish the rules of public economic law. These important changes that characterized the 20th century were followed by the three crises of the first twenty years of the new millennium, which once again brought the State as financier, regulator and entrepreneur, with the European Union which in turn conditions and finances initiatives. The non-attending student, by studying the text, will be able to carry out a complete analysis of the current state-economy relations, of the transformations and perspectives opened up by EU policies.
The course for attending students includes the study of L. Torchia, The Digital State. An introduction (Il Mulino, 2023) and is also divided into modules, dedicated to specific themes and problems of administrative law, which presuppose the student's knowledge of the basic notions acquired with the Administrative Law I course.
The course for attending students includes lectures, with illustration and study of specific problems and cases, with exercises and discussions on the basic materials provided to students and illustrated during the lessons.
Written tests are scheduled for attending students only. The attending student can ask for the grade obtained in the written exam to be recorded, or ask to also take the oral test.
For Erasmus students
The Administrative Law II exam can be taken as part of the Erasmus Program by respecting the procedure set out in the teaching regulations, with a prior request to the teacher. In this regard, please note that the teaching regulations provide that "for the purposes of completing the Learning Agreement, each interested teacher of the Faculty of Law of Roma Tre must be contacted by the student through the relevant area contact person. The contacted teacher must provide the own opinion on the proposed full or partial replacement, agreeing on the possible integration of the program".
