The course – which is preliminary to all other courses in public law – aims at offering the acquisition of the fundamental elements of institutional nature in the domain of public law, and provide an overview on the matters that characterise our legal system.
Furthermore, the course is also aimed at the deepening of issues connected with the judicial concept of security, in its different declinations and in light of its incessant evolution. The relationship between security of rights and the right to security will finally be examined, against the background of constitutional law.

The general section of the course aims to examine the fundamental aspects of the state, the characteristics of the legal system, the organization of public authorities, the sources of law, the effects of Italy's participation in the European Union and international law, the system of territorial autonomy, the protection of fundamental rights and the guarantees provided for this purpose by the national legal system, the activities of public administration, the origins, models, and development of constitutional justice.
Special section
The course then aims to explore the legal concept of security, especially in relation to the protection of rights. This difficult balance between the “right to security” and the “security of rights” will be examined in light of constitutional and supranational case law in particularly sensitive contexts such as the deprivation of personal liberty.

The oral exam consists of three questions: one general question, one more detailed question, and a final question generally on fundamental rights and constitutional justice. The evaluation is expressed as 30/30.
