ll corso si propone di analizzare i concetti e gli istituti fondamentali del diritto privato, cercando di restituire un’immagine d’insieme della materia, trattata come un tutto unitario. Un’enfasi particolare sarà dunque data al diritto privato come “sistema”, cercando di far emergere le connessioni fra le diverse parti del diritto privato.
Seppure il corso ha ad oggetto le “Istituzioni” del diritto privato, queste verranno esaminate richiamando, nei limiti opportuni, gli insegnamenti dell’analisi economica del diritto e della comparazione giuridica.
I temi ai quali sarà dedicata particolare attenzione sono: le situazioni giuridiche soggettive; i soggetti di diritto; i beni, i diritti reali e le situazioni di fatto; le obbligazioni; la parte generale del contratto; i rimedi contrattuali; la responsabilità civile. Sinteticamente saranno presi in esame il diritto di famiglia e la disciplina delle successioni mortis causa e delle donazioni, mentre solo alcuni tra i singoli contratti disciplinati nel codice civile saranno oggetto di considerazione. Non sono parte del programma gli istituti del diritto commerciale e del diritto del lavoro.

Short Bio

Giacomo Rojas Elgueta is an Associate Professor of Private Law at Roma Tre University Law School, where he teaches Private Law and Economic Analysis of Law. He is also licensed as Full Professor of Comparative Law. He is Co-director of the Certificate in International Commercial and Investment Arbitration.
Prof. Rojas Elgueta earned both his law degree (2001, summa cum laude) and his doctoral degree in Italian and European Civil Law (2005) from Roma Tre University. In the academic year 2003/2004 and for the fall semester of 2006, he was a Visiting Scholar at Yale Law School. In 2008 he received an LLM with distinction from the University of Pennsylvania Law School, where in 2014 he also earned an SJD degree (Doctor of Juridical Science).
In addition to several articles in Italian and international law reviews, Prof. Rojas Elgueta is the author of three books on “The Economic Foundation of Debtor-Creditor Relations” (2017), “Contract Freedom and the Limitations on Debtor Liability” (2012) and “Regulation of Insurance Proceeds and Marital Property Law” (2007). He has further co-edited four volumes on a variety of topics. He has been invited to hold classes and seminars at numerous foreign universities, including at the University of Pennsylvania School of Law, New York University School of Law and Sorbonne Université.
In 2008, he was selected as an advisor to the University of Pennsylvania Journal of International Law, and in 2010 as a member of the editorial staff of the Comparative Law Review. He is also a member of the advisory board of Rivista di Diritto Sportivo, of the board of editors of Arbitraje: Revista de Arbiraje Comercial y de Inversiones, and of the board of editors of the Roma Tre Law Review. He is a member of the executive board of the Interdisciplinary Research Center on European Banking and Finance Law “Paolo Ferro-Luzzi” and a member of the team of external experts on bank resolution at the European Parliament. Further, he is a member of Roma Tre University’s international PhD program’s faculty. In 2012 he served as a member of the Drafting Committee (established by the Ministry of Justice) of the new Italian Consumer Bankruptcy Law.
