The course will provide a general survey of western legal history since the fall of the Roman Empire to the 20th Century. It will focus on the main historical sources of legislation, doctrine, and practice of law, on some substantial features of legal institutions of private and public law, offering a statement on their historical establishment and on the many later uses of them in different historical and social contexts.
The course will also show how history has been used by lawyers as a legal argument and will challenge some historiographical interpretations which are largely spread in legal theory.

Short Bio

Emanuele Conte is full professor of Legal History at the Law Department of the University of Roma Tre and Directeur d’Études at the École des Hautes Études en Sciences Sociales in Paris.
He has been Bok Visiting Professor at the University of Pennsylvania (2014) and at: University of Wollongong (Australia) (2015); Australian National University Canberra (2015); École des Hautes Études en Sciences Sociales (EHESS) – Chaire Yan Thomas, Paris, France (2010); EHESS, Paris, France (2008; 2004; 1998); École des Chartes, Paris (2011); École Normale Supérieure Lettres et Sciences Humaines, Lyon, France (2009; 2006); Univ. de Paris X, Nanterre, Fac. de Droit, France (2005); Univ. de Toulouse I, Fac. de Droit, France (2000); Univ. de Paris II Panthéon, Fac. de Droit, France (2000).
He has been visiting research fellow at Wolfson College, Oxford (2018), Columbia University, New York (2019) University of California at Berkeley (1990; 1999), the Max-Planck Institute in Frankfurt am Main (1986-1988).
He is now senior researcher in the ERC project CLCLCL, based at the University of St Andrews (UK).
Professor Conte published 7 books and several dozens of articles in Italian, French, English, German and Spanish, and is editor of one of the six volumes on Cultural History of Law published by Bloomsbury in 2019.
